Terms of service

1. Agreement and eligibility

SteadyMarks is a registered Australian business name operating under ABN 76 882 481 758. These terms are an agreement between the person using the service and SteadyMarks. By creating an account, accepting these terms at checkout or using the service, you agree to them. Our Privacy Policy also explains how we handle personal information.

A parent or guardian creating a family account must be at least 18 years old, have authority to manage the relevant child profiles and provide accurate account information. A student may use SteadyMarks only through access created or authorised by their parent or guardian.

2. The SteadyMarks service

SteadyMarks provides independent exam-style practice, answer saving, marking, review information and supported progress reporting. Available features depend on the selected exam, test, package and account type.

SteadyMarks is not affiliated with or endorsed by the NSW Department of Education or Australian Maths Trust. It does not conduct official examinations, determine admissions or guarantee a score, placement, offer or academic outcome.

Practice scores, skill indicators, explanations and automated feedback are educational aids. Families should use them with their own judgement and, where appropriate, advice from a teacher or other qualified educator.

3. Accounts and family access

The parent account holder is responsible for:

• keeping email, password, student usernames and PINs secure;
• creating child profiles only for children they are authorised to manage;
• keeping profile information accurate and avoiding unnecessary personal information;
• telling us promptly if account access may have been compromised.

Accounts and purchased access are personal to the registered family and must not be sold, transferred or shared outside that family without our written agreement.

4. Free tests and paid practice packs

Free-test eligibility, package inclusions, price, currency and access period are shown before a claim or purchase. Unless checkout clearly states that a charge is recurring, a paid practice pack is a one-off purchase.

Payments are processed by Stripe. Access is normally applied to the selected child profile after confirmed payment. A parent should check the child and package details before paying and keep the order confirmation.

Promotional or free access may have additional limits shown when it is claimed. It has no cash value and may not be resold.

5. Australian Consumer Law and refunds

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law where that law applies. Nothing in these terms limits or excludes those guarantees or any other right that cannot lawfully be limited or excluded.

If a service has a major problem or does not meet an applicable consumer guarantee, you may be entitled to a remedy. For other refund requests, we will consider the package access used, the nature of the issue and the rights that apply to the transaction.

Contact support@steadymarks.com with the order reference and a description of the issue. Do not send payment-card details.

6. Acceptable use

You must not:

• use the service unlawfully, fraudulently or to harm, harass or impersonate another person;
• try to access another family’s, student’s or administrator’s information;
• probe security, bypass access controls, disrupt the service or introduce malicious code;
• use bots, scraping or bulk-download tools to extract tests, answers, reports or account information;
• publish, sell, share or create a competing question bank from SteadyMarks content;
• submit content that infringes another person’s rights or contains unnecessary sensitive information.

Reasonable use of accessibility tools, browser functions and personal notes for the student’s own study is allowed.

7. Content and intellectual property

SteadyMarks and its licensors retain rights in the website, software, practice questions, diagrams, explanations, reports, branding and other service content. Subject to these terms, we give the registered family a limited, non-exclusive, non-transferable right to use the purchased or free content for that family’s personal educational practice during the stated access period.

You retain rights in original written responses you or a student submit. You give us permission to store, process, display and assess those responses only as reasonably needed to provide, secure and improve the service in accordance with the Privacy Policy.

8. Availability, corrections and service changes

We work to keep SteadyMarks available and practice content accurate, but online services may occasionally be unavailable for maintenance, security work or faults. We may correct questions, explanations, scores or technical behaviour when an error is found.

We may improve or replace features. We will not materially reduce an existing paid access entitlement without a reasonable alternative, extension or other remedy where required by law.

If an outage or content fault affects a paid practice pack, contact us so we can investigate and provide an appropriate response.

9. Suspension and account closure

We may temporarily restrict access when reasonably necessary to protect an account, investigate misuse, comply with law or address a material breach of these terms. Where practical, we will explain the reason and provide a way to resolve it.

A parent may ask to close the family account. Closure does not remove payment, audit or other records that we reasonably need to retain by law or for security and dispute resolution. Any refund or continuing-access rights are assessed under section 5.

10. Responsibility and liability

To the extent permitted by law, each party is responsible for loss that was reasonably foreseeable and caused by its breach of these terms, negligence or unlawful conduct. We are not responsible for a student’s official exam result, school decision or other outcome merely because SteadyMarks was used for practice.

Nothing in these terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or a consumer guarantee or other right that cannot lawfully be excluded or limited.

11. Changes to these terms

We may update these terms to reflect service, legal or security changes. We will publish the revised terms and update the date above. We will give reasonable advance notice of a material change that disadvantages account holders.

A change will not retrospectively remove rights attached to an existing paid purchase unless the change is required by law or reasonably necessary to protect the service or its users.

12. Applicable law and contact

These terms are governed by the laws of Australia and the State or Territory whose laws apply to the transaction. The courts and tribunals with jurisdiction under those laws may hear a dispute. This does not restrict any right to bring a claim in a forum available under applicable consumer law.
